Escambia County Marriage Records

Alabama changed its marriage process in 2019, so Escambia County no longer treats marriage as a traditional county-issued license process. Parties complete the Alabama Marriage Certificate, sign it, have it notarized by an Alabama notary, and record it with a probate court. The Escambia County Probate marriage page says marriage license issuance is ministerial and places the burden on the parties to provide complete legal names. Photo identification is strongly recommended because a name or identity issue can delay recording.

Once both parties complete and notarize the certificate, they are considered married. The document still must be recorded within 30 calendar days for a valid Alabama marriage record. The certificate may be recorded in any Alabama county probate court, not only the county where either party lives. A ceremony is optional. If a ceremony is planned, the county guidance says the form should not be notarized until the day of the ceremony, then recorded within 30 days after that event.

The record may include the complaint, answer and waiver, summons, domestic relations information sheet, separation agreement, proposed order, decree, motions, service returns, and court orders.

Uncontested and contested filings have different minimum document sets. The research lists Complaint, Answer and Waiver Affidavit, Domestic Relations Information Sheet, Agreement, Testimony of Plaintiff, Separation Agreement, Divorce Decree or Proposed Order, and Certificate of Divorce for uncontested matters, with Summons added for contested filings. The Circuit Clerk's form is also the route for certified divorce decrees or case-file copies when the online trial-court portal is not enough. The clerk estimates costs before payment, and payment is by money order or cashier's check only after the estimate.
